Privacy Policy and Terms of Service
SEEDSTORIES Terms of Use Rules (Terms) of Conduct Message Boards, Searches and other interactions are provided under the SEEDSTORIES Services. The goal of the SEEDSTORIES is to build community and to provide environment for people of different backgrounds to interact through art, writing, movies and face to face interaction. In keeping with this goal, you, as the user of the SEEDSTORIES Services, including all of the above environments, must agree to abide by these terms and conditions. You agree that any username and password you choose or are assigned is not transferable and can only be used by you. If you violate any of the Terms and Conditions, you may be terminated without notice. This suspension or termination is at the sole discretion of the SEEDSTORIES or their designated Monitor, Moderator or party assigned to supervise all areas of the SEEDSTORIES. The SEEDSTORIES reserves the right to revise our Terms of Conduct (TOC) at any time, at our sole discretion and without prior notice. Any such revisions will be posted and made available from the main the SEEDSTORIES Chat page and other TOC areas on the SEEDSTORIES. You agree that you will periodically review TOC to be aware of any such revisions. If any revision is unacceptable to you, you agree to stop using the SEEDSTORIES Services, including Message Boards and Chat. You may request removal of your Username and Password by writing to the SEEDSTORIES / the SEEDSTORIES or by sending electronic mail to the address at the end of this document. Your continued use of the SEEDSTORIES Services following notice of any such revision(s) shall be conclusively deemed as acceptance of all such revisions. The SEEDSTORIES attempts to create an environment for all individuals, by taking measures to prevent and end offensive behavior directed at any individual. However, SEEDSTORIES can not and does not monitor chat rooms at all times, and makes no guarantee on your experience with this service. Because SEEDSTORIES cannot, at this time, guarantee that the SEEDSTORIES chat is free of all offensive behavior; we encourage users under the age of 18 to use SEEDSTORIES only with adult supervision. By accepting the Terms of Conduct below, you acknowledge that you have thoroughly reviewed and agree to adhere to all Terms while using all the SEEDSTORIES Services including, but not limited to, Chat and Message Boards. Any conduct that, at the SEEDSTORIES discretion, restricts or inhibits any other user from using or enjoying the SEEDSTORIES Services will not be permitted and may result in termination of your account. You agree that you will not use the SEEDSTORIES Services to post, transmit messages (including but not limited to text, graphic, audio and video files or links to the previous) in any of the following ways: 1.You will not use the SEEDSTORIES Services for any unlawful purpose. You agree that you will not, intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law. Violations in this area will result in immediate termination from service, and reporting of your conduct to the appropriate authorities. 2.You will not post foul, vulgar, obscene or sexually explicit language, obscenities, racial epithets, hateful or derogatory words or phrases in any variation. Using such content or language undermines the goals of a Christian community-oriented service, and is not allowed. Please use your best judgment and be respectful of others. If you use such language, even if masked by symbols or other characters, you may either receive a warning by a Monitor, or have your access to both Chat and Message Boards terminated. A warning indicates that your posts are not in keeping with the SEEDSTORIES TOC. If you receive such a warning, you agree to read the the SEEDSTORIES Terms of Conduct again. 3.You will not harass, threaten, or cause distress upon another user or users of the SEEDSTORIES Services or other persons or entities. You may express your disagreement with someone's point-of-view, but personal attacks, or attacks based on another person's race, national origin, ethnicity, religion, gender, sexual orientation, disablement or other such affiliation, are prohibited. A violation in this area may result in a warning or immediate termination from service. If you receive such a warning, you agree to read the the SEEDSTORIES Terms of Conduct again. 4.You will not distribute, promote, transmit or advertise any harmful, hateful, harassing, defamatory or potentially libelous, vulgar, obscene, sexually explicit or sexually solicitous, illegal, racial or otherwise objectionable content, in forms including but not limited to, text, graphics, audio, and video files or providing web links to sites which display or promote the same. Such content undermines the goals of a Christian community-oriented service, and is not allowed. If you post such content, you may face immediate termination from service. 5.You will not disrupt the normal flow of dialogue, post or transmit messages that are not directly related to the specific topics or the "thread" of the messages posted on that board, or otherwise act in a manner that negatively affects other Users, individuals or entities. 6.You will not impersonate any person, including but not limited to a the SEEDSTORIES or the SEEDSTORIES Official, Message Board Moderator, Chat Monitor or Host, or communicate under a false name or a name that you are not entitled or authorized to use. Users must avoid the portrayal of the SEEDSTORIES or the SEEDSTORIES personnel or other persons in all forms of online communication, including, but not limited to, the SEEDSTORIES User Names, the SEEDSTORIES User Profiles, and message postings in either Chat or Message Boards. A violation in this area may result in immediate termination from service. 7.You will not lie or misrepresent age, gender or e-mail addresses using the SEEDSTORIES Services, including, but not limited to your User Profile or postings in OOZETANK contributions or Message Boards. Because of the sensitive nature of the subjects discussed in both Message Boards and Chat rooms, it is necessary to ensure that individuals do not assume identities other than their own. It is allowable and acceptable for Users not to provide their e-mail address to others, as well as to assume a "gender neutral" position on a message board or in a Chat room by not identifying your age or sex. Direct misrepresentation of your e-mail address, age, or gender may result in a warning or immediate termination from service. A warning indicates your conduct is not in keeping with the SEEDSTORIES Terms of Conduct. If you receive such a warning, you agree to read the the SEEDSTORIES TOC again. 8.You will not post, transmit or distribute disruptive content, including but not limited to, chain letters, pyramid schemes, unnecessarily long messages, unnecessary, repetitive posts, meaningless text, offensive declarations or exhortations, "repetitious screaming" or other disruptive content. This material places an unnecessary load on our system and is considered a nuisance by many Users. Certain chain letters and pyramid schemes are illegal. Letters or messages that offer a product or service based on the structure of a chain letter are also of questionable legality. All such messages are prohibited on all the SEEDSTORIES Services. 9.You will not attempt to "crack," "hack," "bomb," manipulate or otherwise disrupt the SEEDSTORIES servers, the SEEDSTORIES Services or software, or any the SEEDSTORIES Live Event in any way. Such behavior is viewed as a serious and immediate effort to undermine and inflict harm to the SEEDSTORIES. Violation of this policy will result in immediate termination from service and potential legal action against the offending party. 10.You will not post, transmit, or distribute any unsolicited advertising, promotional materials or other forms of solicitation to Users, individuals or entities, except in areas designated by the SEEDSTORIES for such purposes. You will not post information to Users, individuals or entities that promotes, arranges or solicits business or business dealings, including but not limited to, multilevel marketing programs, "get rich quick" schemes, trading, buying or selling of goods, except in areas designated by the SEEDSTORIES for such purposes. the SEEDSTORIES does not endorse, warrant or guarantee any product or service offered through the SEEDSTORIES Services and will not be a party to or in anyway monitor any transaction between you and third-party providers of products or services. As with the purchase of a product or service through any medium or environment, you should use caution and your best judgment at all times. Blind opportunity ads and "get rich quick" schemes should be approached with ample skepticism. the SEEDSTORIES cannot mediate disputes and will not assume responsibility for any outcome. Content You acknowledge that, through using the SEEDSTORIES Services, you will be able to access information, communications, software, photos, graphics, video, music, sounds and other materials (collectively "content"). You recognize that communication using the SEEDSTORIES Services often occurs in real-time, or is posted in the SEEDSTORIES Services Message Boards, OOZETANK or libraries and that the SEEDSTORIES cannot, and does not intend to screen all communications in advance. Consequently, the SEEDSTORIES cannot determine in advance the accuracy or conformance of Content transmitted on the SEEDSTORIES Services to the SEEDSTORIES Terms of Conduct. the SEEDSTORIES is not responsible for screening, policing, editing or monitoring such Content. If the SEEDSTORIES is notified of Content which apparently violates the the SEEDSTORIES Services TOC, the SEEDSTORIES may investigate the allegation to determine in good faith and in its sole discretion whether to remove or request removal of such Content from the SEEDSTORIES Services and /or to penalize the User in violation of TOC. You specifically agree that the SEEDSTORIES shall have no liability or responsibility to you in respect of its performance or nonperformance by the SEEDSTORIES of such activities, as long as it has acted in good faith. Use your best judgment in evaluating all information contained or opinions expressed on the SEEDSTORIES Services. Liability the SEEDSTORIES reserves the right to prohibit conduct, communication, or Content on the SEEDSTORIES Services which it deems in its discretion to be harmful to any user, the communities which comprise the SEEDSTORIES Services, the SEEDSTORIES's and third-parties' rights, or to violate applicable law. Notwithstanding the foregoing, the SEEDSTORIES does not have the practical ability to restrict conduct, communication, or Content, which might violate the the SEEDSTORIES Services Terms and Conditions prior to transmission on the SEEDSTORIES Services. Nor can the SEEDSTORIES ensure prompt editing or removal of actually or potentially violating Content after on-line posting. Accordingly, you acknowledge that the SEEDSTORIES shall not assume or have any liability for any action or inaction by the SEEDSTORIES with respect to conduct, communication or Content on the SEEDSTORIES Services. You agree that you will indemnify and hold the SEEDSTORIES harmless for any and all injuries and/or other liabilities, including but not limited to defamation or infringement of intellectual property rights that arises from any Content that you have posted, transmitted, read, downloaded, copied, etc. in connection with the the SEEDSTORIES Services. Copyrights All Content (posted or otherwise) is protected by copyright pursuant to U.S., international conventions, and other copyright laws as a collective work and/or compilation, and the SEEDSTORIES owns a copyright in the selection, coordination, arrangement and enhancement of such Content. You may not modify, publish, post, transmit, participate in the transfer or sale of, reproduce (except as provided below), create derivative works from, distribute, perform, display or in any way exploit, any of the Content, in whole or in part; provided that if no specific restrictions are applied directly or indirectly in relation to a particular item of Content, you may make a reasonable number of copies of such item, including copyright material, provided that the copies are made and used only for your personal use and that you ensure that any notices contained in the Content such as all copyright, trademark, and other proprietary rights notices are reproduced in an unmodified form in all such copies. You may upload to the SEEDSTORIES Services' Message Board areas or otherwise transmit on or through the SEEDSTORIES Services only Content that is not subject to any copyright or other proprietary rights protection (collectively, "Public Domain Content"), or Content in respect of which the holder of any copyright, trademark or other proprietary rights ("Rights") has given express authorization for distribution on the SEEDSTORIES Services without any restriction whatsoever, and in respect of which any moral rights of any person or entity have been completely and irrevocably waived. Any copyright Content submitted with the consent of a copyright owner other than you should contain a phrase such as "Copyright owned by [name of the owner]; Used by Permission." The unauthorized submission of copyright or Content which is otherwise subject of any third party Rights constitutes a breach of the the SEEDSTORIES Services Terms and Conditions and may also render you liable to the holder of such rights. Remember that you alone, not the SEEDSTORIES or its affiliates or independent contractors, are exclusively responsible for any liability resulting from infringement of Rights arising from such submission or transmission. By submitting Content to a Message Board or any other "Public Area" of the SEEDSTORIES Services, you are deemed automatically to grant -- and/or warrant that the holder of any Rights in such Content has completely and effectively waived all such Rights and expressly, validly and irrevocably granted to you the right to grant -- the SEEDSTORIES the royalty-free, perpetual, irrevocable, non-exclusive right (including any moral rights) and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display the Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or hereafter developed for the full term of any rights that may exist in such Content. By submitting Content, you also agree to permit any user to access, view, store and reproduce the Content for personal use. Subject to the foregoing, the owner of Content placed on the SEEDSTORIES Services retains any and all rights, which may exist in such Content. The export control laws of the United States and other jurisdictions regulate the export and re-export of certain technology. This includes the electronic transmission of certain information and software to particular foreign countries and foreign nationals. You agree to abide by these laws -- including but not limited to the United States Export Administration Act, Arms Export Control Act and their implementing regulations -- and not to transfer, by electronic transmission or otherwise, any Content derived from the SEEDSTORIES Services which is governed by or regulated under such laws to a national or a destination prohibited or restricted under such laws without first obtaining any required governmental authorization. You further agree not to upload to the SEEDSTORIES Services any data or software that cannot be exported without prior written government authorization, including, but not limited to, certain types of encryption software. This assurance and commitment shall survive termination of the Agreement. In addition, because U.S. export control laws currently prohibit nationals of Cuba, Iran, Libya, North Korea and Syria from gaining access to certain Content on the SEEDSTORIES Services, nationals of these countries currently may not legally access the SEEDSTORIES Services.
